Here in Redding ... he lost the appeal on the ticket and now owns a bluetooth.

saraz:
awesome. (for the record: my hubby said he wouldn't give you a ticket if he pulled you over and you were using "The Jered". He's cool like that. :)

maryj:
I think its a little rediculous they gave him over a hundred dollar fine, it was his first offence
at 08:41PM 01/08/09
saraz:
the ticket itself is only like $20, but with all the other fees involved it ends up being more.
at 08:43PM 01/08/09
maryj:
yes. thats true.. bet he just uses his bluetooth from now on.. I used my scarf one day in order to keep from getting caught lol

The thing that gets me is that the accidents are caused by the distraction of being involved in another conversation -- not the position of your arm/phone. There is virtually no difference in the accident rate for conversations on a bluetooth.
My cousin works at the CHP academy and I talked to him about it ... he just shrugged his shoulders and told me to talk to the legislature in Sacramento. As if to say "I know, but we have to enforce the laws they pass."

jered:
@saraz -- tell your husband thank you. I might just have to move forward with the prototype.

saraz:
did you see that mythbusters with the cell phone/ drinking while driving test? it's an interesting one. I don't know if they will ever pass a "no cell phone" law. One could argue there is no difference between a conversation with someone physically sitting next to you vs one over the phone.
carliray:
in my opinion the whole cell phone law is humorous. if the legislature in Sacramento had any idea how distracted I am everytime I drive with my three girls...each having their own conversation with me at the same time...they would ban driving with kids in the car instead of cell phones. when I'm on a cell phone its actually an improvement because I am only having to talk to one person.. ;)

jennaliyah:
Carli... so funny, I just had a conversation with a man in the bank yesterday about kids being way more distracting then cell phone usage...
maryj:
Carli you are SO right! I don't know how many times I have almost gotten in an accident cause I was paying more attention to the kids than to the road.. I will admit although painfully embarrassing, while backing out of my parent driveway one day and having a discussion with the boys, I backed into my dads truck with my little BMW, lets just say the BMW fared much better than my dads truck.. he did however in my offense say that if he had not parked where he always told me NOT to park for that very reason his truck would not have gotten hit...did I mention that I had back up sensors? haha

jessie:
Hands free isn't hands free, huh? I put my phone on speaker and close it over my shirt. Is that against the law too?
at 06:21AM 01/15/09
jered:
Yes. The law says you have to use a bluetooth device. But I see people holding the phone in front of their mouths all the time. Technically not OK. It's really dumb.

jessie:
when I read the law, it said that speaker phone was ok. unless they changed it.
Drivers 18 and over are allowed to use a “hands-free” device to talk on their wireless telephone while driving. The following FAQs apply to those motorists 18 and over.
Q: Does the “hands-free” law prohibit you from dialing a wireless telephone while driving or just talking on it?
A: The law does not prohibit dialing, but drivers are strongly urged not to dial while driving.
Q: Is it legal to use a Bluetooth or other earpiece?
A: Yes, however you cannot have BOTH ears covered.
Q: Does the “hands-free” law allow you to use the speaker phone function of your wireless telephone while driving?
A: Yes, as long as you are not holding the phone.
Q: Does the “hands-free” law allow drivers 18 and over to text message while driving?
A: The law does not specifically prohibit that, but an officer can pull over and issue a citation to a driver of any age if, in the officer’s opinion, the driver was distracted and not operating the vehicle safely. Sending text messages while driving is unsafe at any speed and is strongly discouraged.

jessie:
But it has since changd to no texting as of january 1, 09
at 08:13PM 01/15/09
jered:
Yeah, so you can use speaker as long as you aren't holding the phone. See what I mean about how ridiculous this law is?
at 08:48PM 01/15/09
saraz:
your hands cannot be on the phone, using speaker phone or otherwise.

I am one of those who has a sign that says " Hang up and drive.." ... Interesting since I DONT own my own cell phone nor drive.. :) ...
But honestly I have seen some dangerous drivers and its always because they are doing something OTHER than driveing.. I cant wait untill the day we dont have to drive, but the car takes us where we want to go on auto pilot.. :) OH wait! That must have been in a movie I saw once.. :)

jessie:
what about drinking starbux and driving or eating and driving? and of course we have already covered kids in the car & driving.

nichole:
I just saw this and from what I heard you could hold the phone while on speaker as long as it wasn't to your ear.... I never read the other... whoops. I even driven right next to police talking on speaker not realizing it mattered.
tovah:
I have to admit I have bumped into someone while dialing before, but no damage was done. David on the other hand ran a red light and totaled our van when he thought Josiah was getting into the ice cream he had just bought in the back seat. Needless to say we now have a legal system instead of a justice system, and if the law makes money for someone influential it is easy to pass. ...I am glad I live in OR :)
